Terms of service
Draft: this page is still being reviewed and some details are not filled in yet.
Last updated: 2026-10-31
These terms are the agreement between you and [[ENTITY NAME]], [[ADDRESS]] ("Delicious Mail", "we", "us"). They cover our website, free tools, checkout and app (together, the "Service").
By creating an account, paying at checkout, or using the Service, you agree to these terms. If you use the Service for a company, you agree for that company, and "you" means the company.
Please also read our Privacy Policy and the Acceptable Use section below (section 7).
1. The Service
Delicious Mail helps you set up and run cold email. In the app you can:
- connect domains you own, or buy new or aged domains;
- create mailboxes and set up their DNS records;
- warm up mailboxes;
- check DNS health and contact lists;
- write and send campaigns and follow-ups;
- handle replies in one inbox and track deals;
- ask Ask Basil, our in-app assistant, for help.
We also offer free tools: an SPF, DKIM and DMARC checker, an email spam test, and a warm-up schedule calculator.
We may change, add or remove features over time. If we remove a core feature you pay for, we will tell you first.
2. Your account
- You must be at least 18 and able to enter a contract.
- Give us accurate details and keep them up to date.
- Keep your password safe. You are responsible for everything done in your account, including by teammates you invite.
- Tell us right away at support [at] deliciousmail.com if you think someone has used your account without permission.
3. Plans, billing, renewal and refunds
The short version: your plan renews automatically until you cancel. You can cancel at any time from Settings. Refunds follow the policy below.
- Plans. We offer Starter, Growth and Scale plans. Prices, limits and features are shown on our pricing page and at checkout.
- Billing cycle. Plans are billed in advance, monthly or yearly where offered. Your plan renews automatically at the end of each billing period, at the price then in effect, until you cancel.
- Payment. You pay through Stripe (card), PayPal, Paddle or Lemon Squeezy. Paddle and Lemon Squeezy may sell to you as the reseller ("merchant of record"). In that case, their terms of sale also apply to your purchase. You authorize us, or that provider, to charge your payment method on each renewal.
- Taxes. Prices do not include tax. Tax is calculated at payment.
- Coupons. Coupon codes apply only on their stated terms and have no cash value.
- Changing plans. You can upgrade or downgrade from Settings. Changes take effect at your next billing date.
- Cancelling. You can cancel from Settings at any time. Your plan stays active until the end of the period you paid for, and then it does not renew.
- Failed payments. If a payment fails, we will let you know. If we can't collect payment, we may pause sending or suspend your account until it is paid.
- Price changes. We will tell you by email before a price change. The new price applies from your next renewal. You can cancel before then.
- Refunds. We do not refund unused time on a plan, and we do not refund unused spam test packs. When you cancel, your plan is not renewed at the end of the period you paid for. You keep access until that period ends, and you are not charged again. Nothing is refunded for the days left in the period.
4. Add-ons and spam test packs
- Add-ons. You can add extra mailboxes, mailbox warming, pre-warmed mailboxes, and dedicated IP addresses. Dedicated IPs are available on Growth and Scale only. Add-ons are billed with your plan, on the same cycle, at the prices on our pricing page. They end when your plan ends.
- Spam test packs. Spam test packs are a one-off purchase, separate from plans. They do not renew. [[TEST PACK EXPIRY]]
- Domains you buy through us. A domain you buy in the app is registered for your use. It is also subject to the rules of the domain registrar and registry. Domains renew each year unless you turn renewal off. You can transfer a domain out at any time.
5. Free tools and fair use
- Our free tools are offered as is, with no guarantee that they are available or accurate at all times.
- Free spam test limit. If you are not logged in, you can run 5 free spam tests a day. After that, you can buy a test pack or use the tests included with a plan. Logged-in customers use their plan's allowance instead.
- Share links. Each spam test report has a share link. Anyone who has the link can view the report. Links expire after 30 days.
- DNS checker. The checker runs in your browser and uses public DNS services run by Google and Cloudflare. Its results depend on those services.
- Fair use. Do not get around the free limits, for example by changing IP addresses or clearing stored data. Do not use bots or scripts to run the tools at volume, resell their results as a service, or put an unfair load on our systems. We may block or limit use that breaks these rules.
6. Your content and mailbox access
Your content means the domains, mailboxes, contact lists, campaign content, replies, deals and other information you add to or handle through the Service. You own your content.
You give us a worldwide, non-exclusive, royalty-free license to host, copy, process, send and display your content. We may do this only to run and improve the Service for you, to keep it secure, and as the law requires.
Mailbox and domain access. When you connect a mailbox or domain, you authorize us to act for you. That means we may:
- sign in to the mailbox with the login details or access token you give us;
- send warm-up emails, campaigns and follow-ups from it;
- read incoming mail to show your replies, and find, move and filter out warm-up emails;
- read and, where you ask us to, set DNS records for your domains.
Warm-up pool. Mailboxes that are warming take part in our shared warm-up pool. They send and receive warm-up emails with other mailboxes in the pool, which may belong to other customers. Warm-up emails are written by us and never contain your campaign content or contacts. You agree not to read, reply to, report, or interfere with warm-up emails from other mailboxes, except as the Service does for you automatically.
Your promises. You promise that:
- you own, or have permission to use, every domain, mailbox and contact list you connect or upload;
- you have a lawful basis to email each person on your lists;
- your content does not break the law or anyone's rights.
You can disconnect a mailbox or domain at any time. When you do, we stop using it.
Where the GDPR or UK GDPR applies to contact data you process through us, we act as your processor. Email privacy [at] deliciousmail.com to ask for our data processing agreement.
7. Acceptable use
Delicious Mail is for relevant outreach to real people who could reasonably want to hear from you. It is not for spam. These rules protect your sending reputation, other customers, and the people you email.
Follow the law
You are responsible for following every law that applies to your email, including:
- CAN-SPAM (United States);
- CASL, Canada's anti-spam law;
- the GDPR and the ePrivacy Directive in the EU, and the UK GDPR and PECR in the UK;
- any other email marketing, privacy or consumer law where you or your recipients are.
Every email you send must
- show who you really are. Use an accurate sender name, From address and reply-to address. Include your real physical postal address where the law requires it;
- have a subject line that matches the message and is not misleading;
- include a clear, working way to unsubscribe;
- go only to people you have a lawful basis to contact.
Honor unsubscribes
- Act on every unsubscribe and opt-out request within two days, and never later than the law allows.
- Never email someone again after they opt out, including from another domain or mailbox.
- Keep a suppression list and use it.
Lists
- Do not send to purchased, rented, harvested or scraped lists where the law or the list's terms prohibit it.
- Do not use lists made by guessing addresses or by dictionary attacks.
- Check your lists before you send, and remove addresses that bounce.
Never send
- phishing, or anything that tries to collect passwords, payment details or other sensitive data by deceit;
- malware, viruses, or links to them;
- deceptive content, such as fake invoices, fake replies, "Re:" or "Fwd:" on a first email, false urgency, or impersonation of another person or brand;
- content about illegal products or services, or that promotes illegal activity;
- content that is hateful, harassing, threatening, sexually explicit, or that exploits children;
- content in any category your email provider, our infrastructure providers, or applicable law prohibits.
Don't abuse the Service
- Do not try to hide your identity, or the source of your mail, by forging headers or using domains you don't control.
- Do not try to get around sending limits, warm-up schedules or slow-downs.
- Do not abuse the warm-up pool. That includes sending campaign content through it, or using it to inflate engagement.
- Do not test or break our security, reverse engineer the Service, or use it to build a competing product.
- Do not resell or share access to the Service unless we agree in writing.
Our right to act
To protect deliverability for everyone, we watch signals such as bounces, spam complaints and blocklist listings. Keep reported spam below 0.3% of what you send. If a mailbox, domain or IP address gets spam complaints, a high bounce rate, or a blocklist listing, or if we believe you are breaking this section, we may:
- slow down or pause sending;
- pause warm-up;
- disconnect a mailbox, domain or dedicated IP;
- suspend or close your account.
We will usually tell you why and give you a chance to fix the problem. We may act first, without notice, when there is a serious risk to other customers, recipients, or our infrastructure, or when the law requires it. We may report illegal activity to the authorities.
8. No deliverability guarantee
We work hard to get your mail into the inbox. But each email provider decides where mail lands, and that depends on many things we don't control, such as your content, your lists and your past sending. We do not guarantee any inbox placement, open rate, reply rate or result. Spam test scores, DNS checks and warm-up schedules are guides, not promises.
9. Our intellectual property
We own the Service, including its software, design, text, and the Delicious Mail name and logos. We give you a limited, non-exclusive, non-transferable right to use the Service while these terms apply. You get no other rights.
If you send us feedback or ideas, we may use them without owing you anything.
10. Third-party services
The Service works with services we don't control. These include email providers, domain registrars, payment providers and public DNS services. Your use of them is also subject to their terms. We are not responsible for them, and changes or outages on their side may affect the Service.
11. Warranty disclaimer
To the extent the law allows, the Service is provided "as is" and "as available." We make no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not promise that the Service will be uninterrupted, error-free or secure.
Some places don't allow these exclusions. If so, they apply only as far as the law allows.
12. Limitation of liability
To the extent the law allows:
- we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data, goodwill or business opportunities;
- our total liability for all claims about the Service is limited to the amount you paid us in the 12 months before the event that led to the claim.
These limits don't apply where the law does not allow them, such as liability for fraud, or for death or personal injury caused by negligence.
13. Indemnity
You will defend and indemnify us, and our staff and partners, against any claims, fines, losses and costs (including reasonable legal fees) that arise from:
- your content or your email campaigns;
- your breach of these terms, including section 7;
- your breach of any law or of anyone's rights.
We will tell you about the claim and let you control the defense. You may not settle a claim that admits fault for us without our written consent.
14. Suspension and termination
- By you. You can close your account from Settings at any time. Cancelling a plan works as described in section 3.
- By us. We may suspend or close your account if you break these terms, don't pay, or put other customers or recipients at risk. Section 7 explains how we handle sending problems.
- After closing. Your right to use the Service ends. We stop all sending from your account. We delete your data as described in our Privacy Policy. Export anything you need before you close your account.
- What survives. Sections that by their nature should continue after the account ends will continue. These include sections 6 (your promises), 9, 11, 12, 13 and 16.
15. Changes to these terms
We may update these terms. If a change matters, we will email you at least 30 days before it takes effect. If you keep using the Service after that date, you accept the new terms. If you don't agree, you can cancel before the change takes effect.
16. Governing law and disputes
These terms are governed by [[GOVERNING LAW]], without regard to its conflict-of-law rules. The courts of [[VENUE]] have jurisdiction over any dispute. Nothing here takes away rights you have under the consumer laws of the place you live.
Before starting a legal claim, please contact us at legal [at] deliciousmail.com so we can try to resolve it.
17. General
- These terms, together with our Privacy Policy and anything you agree to at checkout, are the whole agreement between us about the Service.
- If any part of these terms can't be enforced, the rest still applies.
- If we don't enforce a right straight away, we have not given it up.
- You may not transfer these terms without our written consent. We may transfer them as part of a merger, sale or reorganization.
- Neither of us is responsible for delays caused by events beyond reasonable control.
